ILO Maritime Labor Convention 2006

Ship-owner |
(definition as per MLC)=the owner of the ship or another organization or person, such as the manager, agent or bareboat charterer, who has assumed the responsibility for the operation of the ship from the owner and who, on assuming such responsibility, has agreed to take over the duties and responsibilities imposed on shipowners in accordance with this Convention, regardless of whether any other organization or persons fulfill certain of the duties or the responsibilities on behalf of the shipowner.

CBA |
Collective Bargaining Agreement. A labour contract agreed between an employer and one or more trade unions for a group of workers. It sets out all the terms and conditions of employment for those workers.

CHA |
Crew Hire Agreement. The contract which is signed between the Crew Manager and the clients, and outlines the Terms & Conditions of our cooperation, contractual agreement and obligations. |

MLC Addendum to the CHA |
A Legal Document which has to be countersigned between the Crew Manager and Crew Management Customers. The Document will provide details and will list a number of the Shipowner’s responsibilities (as those are defined in the ILO MLC), which will be subcontracted to the Crew Manager as the employer of crew. The document once signed, will have to be placed onboard all your vessels, and will have to be made available to auditors/ inspectors during ILO MLC onboard audits and PSC inspections. The MLC Addendum to the C.H.A will provide evidence that a number of ILO MLC provisions have been subcontracted to the Crew Manager since the CHA for obvious reasons (confidential information), cannot be placed onboard. |
